A constant and intensive market monitoring system has therefore been developed to enable Cadorin Group S.r.l. to identify unfair practices such as the marketing of counterfeit products, unauthorized use of distinctive signs, the dissemination of misleading advertising, and copyright infringement. This system — which allows the company to gather information enabling it to act effectively by initiating the most appropriate measures, including precautionary and urgent actions before the competent authorities, to stop infringements and seek proper compensation for the serious damages suffered, both economic and reputational — has already proven effective, allowing timely intervention in various situations.

It is worth recalling that the law grants the owner of a registered trademark the right to prohibit unauthorized third parties from using that trademark (or similar signs) for the manufacture, promotion, and sale of the products for which the trademark has been registered, as well as for similar products. The infringement of a registered trademark may also constitute a criminal offense.

Similar considerations apply to the violation of other exclusive rights, such as patents and designs, as well as the misappropriation of third-party copyrights.

The law also prohibits unfair competitive practices, including the use of names or distinctive signs likely to cause confusion, slavish imitation, other acts capable of creating confusion, misappropriation of merits, and, in general, any conduct that is contrary to the principles of professional fairness and likely to harm another business.

Cadorin confirms its firm intention to continue its fight against all those who infringe its intellectual property rights, use its distinctive signs without authorization, disseminate misleading advertising intended to unlawfully exploit its commercial image, and engage in any conduct that harms not only the company, but also its distributors and consumer trust.

It is therefore the company’s intention to intensify its ongoing and meticulous market monitoring activities and to undertake all appropriate actions to protect its image, its industrial property rights, and the right to fair and accurate commercial communication.
